India is gearing up for a pivotal trade agreement with the United States, but the path forward demands careful navigation amid shifting policies and mounting pressure from Washington. The deal, which could significantly bolster economic ties with the world’s largest economy, comes at a time when both nations are grappling with contentious issues, including tariffs, forced labour, and energy trade.

US Tariffs and Forced Labour Policy

The backdrop to the negotiations is the US Trade Representative’s (USTR) proposal to impose tariffs on 60 countries under Section 301 of the US Trade Act, 1974. In response, India has introduced new provisions in its foreign trade policy addressing forced labour concerns, aligning itself with similar commitments made by Indonesia, Canada, Cambodia, and Peru.

India has also sought a review of the USTR’s proposed 12.5 per cent tariffs, flagging inconsistencies in the examination process. This is compounded by the operationalisation of US President Donald Trump’s tariff policy under Section 122 of the Trade Act, which allows the imposition of a 10 per cent universal tariff rate for a maximum of 150 days without Congressional approval. This period ends on July 24, leaving uncertainty over whether Trump will pursue alternative pathways to reinforce tariff barriers.

Energy Trade Under Scrutiny

Energy trade has emerged as another contentious issue. A group of US senators recently unveiled a revised Russia sanctions bill proposing tariffs of up to 100 per cent on the top five buyers of Russian oil and natural gas, including India. Given that imports from Russia constitute a substantial portion of India’s energy basket, this measure could have far-reaching implications.

To address US concerns, India has already taken steps to diversify its energy imports. Public sector undertakings have signed agreements to source 10 per cent of the country’s LPG requirements from the US. This move underscores New Delhi’s efforts to mitigate risks while maintaining strategic autonomy in its energy policy.

Why the Deal Matters

A trade agreement with the US could help reduce the uncertainty that has long plagued bilateral relations, while opening up new avenues for expanded trade. India has recently concluded deals with the UK, Australia, and the EU, demonstrating its intent to strengthen global trade partnerships. A successful deal with the US would further cement India’s position as a key player in international trade.

Navigating an Unpredictable White House

Despite the potential upside, India must remain cautious as it negotiates with an unpredictable White House intent on extracting maximum concessions. Balancing domestic interests with external demands will be crucial for New Delhi as it seeks to expand its market and safeguard its strategic priorities.

The stakes are high, and the outcome of these negotiations could shape the trajectory of India-US relations for years to come.
