Shamli: An elected member of the Shamli Municipal Council, Anil Kumar Upadhyay, has submitted an application to the Superintendent of Police seeking a fair and effective investigation into the incident that took place on 19 September at the office of Shamli Municipal Council Chairman Arvind Singal.

Along with requesting an impartial investigation, Upadhyay has also sought the immediate preservation of the CCTV footage, digital video recorder (DVR) and other electronic evidence linked to the incident.

According to the application, councillor Anil Kumar Upadhyay has alleged that a serious incident took place with him on 19 September inside the office of the Municipal Council chairman. He has alleged that, as part of a conspiracy, a crowd was provoked and a situation was created in which he came under attack.

The application states that following the alleged incident, Upadhyay had to run towards Kotwali Shamli in order to save his life. It also mentions that an FIR has been registered at Kotwali Shamli in connection with the incident. The FIR number cited in the application is 0429/2026.

The application further states that various sections of the Bharatiya Nyaya Sanhita, along with Section 109(1), have been invoked in the case. Upadhyay has expressed apprehension that the investigation could be influenced under pressure from influential people.

He has also raised the possibility that efforts could be made to remove Section 109(1) from the case or to present the seriousness of the incident in a reduced manner. However, these concerns have been presented as an apprehension in the application.

The councillor has requested the Superintendent of Police to ensure that any change in the sections mentioned in the FIR is made only on the basis of an impartial investigation, the available evidence and competent legal examination.

He has specifically sought the immediate preservation of CCTV footage from the time of the incident, the DVR, mobile phone videos and other electronic evidence. According to the application, this is necessary to ensure that important evidence is not destroyed during the investigation.

Upadhyay has finally requested a proper examination of the circumstances surrounding the incident and impartial action in the matter.
