New AI laws should target data governance, safety to build public confidence: experts

Hong Kong authorities have pledged to tackle disputes or crimes involving artificial intelligence through tailored legislation, while experts are calling for rules covering data governance and underlying safety standards.

The experts said such laws would help ensure the responsible use of AI and respond to risks linked to its expanding application.

They also said legislation should define liability boundaries, which could strengthen business and public confidence in adopting the technology.

Government to review existing laws

Chief Executive John Lee Ka-chiu said in his recent policy address that authorities would study new legislation to tackle cyber-enabled crimes.

He also said a working group led by the Department of Justice would examine whether existing laws were adequate to address liability issues arising from accidents or damage caused by AI products.

The proposed review places responsibility and legal accountability at the centre of the government’s response, while experts have separately stressed the need for clearer safety standards and data governance rules.

Their call comes as authorities consider legislation aimed at disputes and crimes involving the technology’s application.

Police identify AI as a major cyber threat

Police have identified AI as one of the five major cyber threats in 2026.

The force has recorded cases in which suspects used AI-generated materials for scams.

It has also recorded cases involving fabricated identity cards with deepfakes, which were used to set up bank accounts for money laundering.

These cases form part of the context behind calls for clearer rules on how AI is developed and used, and on who should be held liable when AI products cause accidents or damage.

For experts, defining those boundaries is important not only for addressing harm but also for building confidence among businesses and the public as AI adoption expands.
