The Union Law and Justice Ministry has rescinded a flawed gazette notification that mistakenly republished results of West Bengal by-elections to three Rajya Sabha seats instead of announcing the outcome of the Mizoram election, according to government and Election Commission sources. The error, made on Monday, was corrected the same day with the issuance of a new, accurate notification.
Notification Error and Correction
The initial notification, issued under Section 67 of the Representation of the People Act, 1951, was intended to declare the result of the Mizoram Rajya Sabha election. Instead, it repeated details from a July 17 notification concerning the by-elections of three Rajya Sabha seats in West Bengal.
The July 17 notification had declared the re-election of former Trinamool Congress MPs—Sushmita Dev, Prakash Chik Baraik, and Sukhendu Sekhar Ray—who joined the BJP in June and contested on BJP tickets.
Upon identifying the error, the Law Ministry promptly withdrew the incorrect notification and issued the correct one. The updated gazette confirmed the election of Khiangte Laltluangkima, a leader of the Zoram People’s Movement, to the Rajya Sabha seat from Mizoram.

The swift correction underscores the importance of accuracy in official election notifications, which serve as the final legal declaration of election outcomes. Such errors, if left unaddressed, could lead to confusion or disputes regarding the legitimacy of elected representatives.
