Telangana High Court Orders College To Refund BHMS Student's ₹3.32 Lakh Fee
Telangana High Court directed a private medical college to refund Rs 3.32 lakh tuition fee after a student's BHMS admission was cancelled over NEET marks.
A student whose BHMS admission was withdrawn over her NEET score must get back the ₹3.32 lakh tuition fee she had paid, the Telangana High Court has directed.
Justice Juvvadi Sridevi said the cancellation of admission, whatever the justification, could not allow the institution to retain tuition money for a seat in which the student was not permitted to continue.
Seat allotted, then cancelled
D. Shabari Priya was initially allotted admission into the BHMS course at Guru Nanak Homoeopathic Medical College and Hospital at Ibrahimpatnam.
The allotment was made in 2025 under the management quota, following an allotment letter issued by Kaloji Narayana Rao University of Health Sciences.
The university later cancelled the admission on the ground that she had secured 128 marks in NEET, instead of the required 144 marks.
Court rejects retention of fee
The High Court directed the private medical college to refund the entire tuition fee of ₹3.32 lakh paid by the student.
Justice Sridevi said the cancellation of admission could not result in “unjust enrichment” of the institution by retaining the amount paid towards tuition.
The judge also said the petitioner could not be made to suffer the financial consequence of a mistake, if any, committed by the university.
The ruling matters because the court separated the validity of the admission cancellation from the college’s right to keep the fee after the student was not allowed to continue in the course.
