Supreme Court Quashes FIRs Against Comedian Samay Raina

The Supreme Court on Friday quashed criminal proceedings against comedian Samay Raina and four other social media influencers for remarks deemed offensive to people with disabilities. The court acknowledged their subsequent efforts to promote awareness and dignity for disabled individuals, including organising events to support those affected by rare diseases like Spinal Muscular Atrophy (SMA).

Chess Tournament for Disabled Persons Praised

The bench, led by Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana, commended the group’s initiative in hosting a chess tournament in March aimed at raising awareness about disability rights. The court noted that such efforts reflect a positive shift in their actions. "Once there are genuine efforts, positive results are bound to be there," the bench observed.

The FIRs had initially been filed over jokes made by Mr. Raina, host of "India's Got Latent," alongside comedians Vipul Goyal, Balraj Paramjeet Singh Ghai, Sonali Thakkar, and Nishant Jagdish Tanwar. The SMA Cure Foundation, which advocates for individuals suffering from SMA, had flagged these remarks as offensive.

Court Closes Case, Eyes Larger Issue

Senior advocate Aparajita Singh, representing the SMA Cure Foundation, informed the court that the influencers had since engaged meaningfully with the foundation and demonstrated genuine efforts to address concerns. The court closed the case, stating the matter against these individuals was resolved.

However, the bench hinted at the need for broader guidelines to protect the dignity of disabled persons, a subject it plans to deliberate further. Chief Justice Surya Kant revealed that he and other judges had interacted with a delegation of disabled individuals the day before, describing it as an "eye-opener." Paralympians and other representatives shared suggestions during the meeting.

Commitment to Continued Advocacy

The influencers have pledged to continue their advocacy efforts, including inviting individuals with SMA to their shows and organising fundraising events. Last November, they had voluntarily committed to hosting at least two events per month to support financial aid for SMA patients.

This ruling underscores the court's recognition of corrective actions and its focus on fostering a more inclusive society for persons with disabilities.
