Hong Kong and Mainland China Courts Enhance Cross-Border Legal Cooperation

In a significant move to enhance judicial cooperation, Hong Kong and mainland Chinese courts have initiated deeper exchanges to address cross-border legal challenges, particularly in commercial law. This month, a specialised training course was co-organised by the High People’s Court of Guangdong Province, the Guangdong Judicial Training College, the Hong Kong Department of Justice, and the Hong Kong International Legal Talents Training Academy to foster mutual understanding of legal concepts.

Focus on Cross-Border Commercial Law

The training, held over three days, focused on guarantees and securities for loans, a topic chosen for its frequent role in commercial disputes involving both jurisdictions. More than 100 judges participated, primarily from the Greater Bay Area, but also from neighbouring provinces like Guangxi, Hunan, and Hainan. Hong Kong contributors included a High Court judge and members of the Inner Bar, while mainland speakers featured a judge from the Supreme People’s Court and commercial judges from Guangdong’s High People’s Court.

The specificity of the course marked a departure from general discussions about the differences between the two legal systems. Instead, it delved into detailed aspects of guarantees and security interests, with one session covering charges under Hong Kong’s Companies Ordinance.

Why It Matters

The initiative reflects the growing economic integration between Hong Kong and mainland China, particularly in the Greater Bay Area. With increasing cross-border commercial activities, disputes often involve both legal systems, necessitating a deeper understanding of each other’s laws to deliver effective justice.

Under the “one country, two systems” framework, Hong Kong operates under a distinct legal system from mainland China. While this difference has often been a focal point in discussions, the training underscores a shift towards addressing practical legal challenges collaboratively.

This effort signals a commitment to bridging gaps in legal interpretation and application, paving the way for more seamless resolution of cross-border disputes in the future.
