Hong Kong International School pays substantial penalty to end Lutheran Church partnership

Hong Kong International School has paid a "very, very substantial penalty" to the Lutheran Church, Missouri Synod to dissolve their decades-long partnership, a source close to the matter has confirmed, describing the split as the end of a troubled relationship that would have spawned further legal battles.

The out-of-court settlement resolved a lawsuit filed by the US church group, which co-founded the school, though the LCMS regards the payment not as compensation but as a necessary penalty for what it views as multiple breaches by the institution.

Church cited mission drift, financial reserves

The Lutheran Church, Missouri Synod had accused HKIS of serving only the "rich and privileged few", violating its founding mission and accumulating large financial reserves. The church framed the payment as redress for the school's failure to align with Lutheran values.

The source acknowledged that the settlement "might give the impression that the church had filed the lawsuit for pecuniary reasons", but insisted the LCMS viewed the penalty as justified given what it characterized as "fundamental" differences between the parties.

School alleged commercial motive behind suit

School management countered that the LCMS' legal action was financially motivated, pointing to the church's exploration of multiple options to develop part of the Repulse Bay campus into a US$1 billion commercial project.

Court documents showed the plaintiff had threatened to evict HKIS from the Repulse Bay site and sought an indemnity of US$1.75 million. The Lutheran Church, Missouri Synod remains the registered owner of the campus.

The source told the South China Morning Post that continuing the partnership would have led to more litigation given the parties' irreconcilable differences.
