Court halts takeover bid at Greater Noida housing society after bouncer allegations

A court has issued a status quo order in a deepening dispute over the handover of maintenance management at Supertech CZAR, Omicron-1 in Greater Noida, following allegations of a forcible takeover attempt involving outside bouncers. The directive ensures that the existing facility management arrangement remains in place pending further orders from the competent court or High Court.

Advocate V.K. Sharma, who has been closely involved in the matter, stated that a few days ago a group allegedly attempted to forcibly take control of the current facility management system. During this episode, allegations were also raised about the presence of external bouncers who were brought in to facilitate the takeover.

After a timely demand for intervention by the authorities, the concerned court has now directed that the status quo be maintained regarding the disputed handover and maintenance arrangement. This order is subject to any subsequent directions from the competent court or High Court.

The controversy has its roots in an earlier dispute over the formation of the Association of Apartment Owners (AOA) at the society. According to Advocate V.K. Sharma, the current AOA was constituted through an election process in which more than 1,800 residents out of approximately 2,000 units were allegedly not given an opportunity to participate. Sharma has filed Civil Suit No. 2251/2026 in connection with this matter.

Sharma stated that last year as well, the association had attempted to take control of the existing facility management system. At that time, he had lodged an objection before the IRP, arguing that several important infrastructure works related to the society were still pending. According to him, the IRP accepted the objection and the existing arrangement continued.

Following this, the association approached the NCLAT regarding the maintenance handover. Sharma intervened there as well against the proposed handover. He stated that after the Supreme Court constituted an Apex Court Committee to consider and monitor matters related to Supertech projects, both the related matters were disposed of.

Subsequently, the association filed a restoration application in the NCLAT, in which Sharma has also intervened on his side.

Sharma has alleged that without waiting for a hearing and decision on the restoration application, approximately three days ago some people attempted to take over the maintenance system with the help of external bouncers.

Anticipating the situation, Sharma claimed that he met the ACP on 9 September and informed them about the matter. Thereafter, on 10 September, an urgent application was filed before the court seeking protection from any forcible takeover. He also stated that he informed the DCP about the matter.

Following the court's status quo directive, the situation regarding the existing maintenance arrangement at CZAR has remained stable for now. According to Sharma, this has helped avert potential disruption to water, electricity, lift, security, sanitation and other essential services.

He said that if there is a legal right and permission from a competent authority for any handover, it should be implemented through the legal process rather than through force, external bouncers or confrontation.

Appealing to all parties to respect the judicial process, Advocate V.K. Sharma said that the decision on the disputed handover should be based on transparency, prescribed legal procedure and the orders of the competent authority or court. He emphasized that no one should take the law into their own hands.

For the present, the court's status quo order remains in force in the matter, and further action will depend on the decisions of the relevant judicial and competent authorities. The dispute highlights the ongoing tensions between residents and the association over control of the society's maintenance operations and the legitimacy of the AOA's formation itself. The case underscores the importance of following due legal procedures in matters involving community assets and services that affect the daily lives of thousands of residents.
