A nearly 30-year-old legal dispute over government nazul land in Gonda has reached a major turning point, with plaintiff Dayanand Mishra filing an affidavit before the court saying he does not wish to pursue the case further and requesting that the proceedings be ended.
More importantly, Dayanand Mishra has also himself removed his 30-year-old possession from the government land. The development has taken place amid continuous monitoring and effective legal follow-up by Devipatan Mandal Divisional Commissioner Durga Shakti Nagpal, who has been working to implement CM Yogi’s intent on the ground in matters related to protection of government land.
The case relates to nazul plot numbers 514, 515, 524 and 525 in Gonda, which are reserved for the Commissioner’s office and building. The matter had been pending in court since the year 1997. Even after a stay order was passed in 2008, legal follow-up continued in the case involving government land. During the campaign to free government land from encroachment, this old case came to the attention of the administration.
After information about this long-pending case involving government land came forward, Divisional Commissioner Durga Shakti Nagpal reviewed the matter continuously. The records and the court status were examined, and the officials concerned were instructed to strongly present the government’s side and ensure effective legal advocacy for the protection of government interests.
During the inquiry, it also came to light that an illegal school was being run on the land. The administration got the spot situation checked. At present, no student or teacher was found there. After this, the actual position of the land at the site was also monitored.
In the case, plaintiff/encroacher Dayanand Mishra, Advocate, resident of village Chhavani Sarkar Anandpuri, Civil Line, Gonda, has submitted an affidavit in court. In this affidavit, he has requested that he will not pursue the case further and that the proceedings be ended.
The most important aspect of the case is that the party concerned not only stepped back from legal follow-up in court but also removed his possession from the spot. This means that in a dispute pending for three decades, there has now been a change both at the level of court proceedings and in the physical position of the land.
The dispute, which began in the year 1997, has spent nearly three decades in the judicial process. The matter remained pending even after the 2008 stay order. Now, in 2026, after the affidavit by the plaintiff and the removal of possession from the spot, the administration is faced with the responsibility of keeping these plots secure.
These plots, reserved for the Commissioner’s office and building, will now be secured, and action will be taken to ensure their use for the designated government purpose. The latest development has moved the long-running matter toward protection of government land and its planned official use.
At the administrative level, old and pending cases are being reviewed for the protection of government land and to free it from illegal encroachments. In the same sequence, the file of this three-decade-old nazul land case was reopened, and both the court position and the actual ground situation were examined.
Under the monitoring of Divisional Commissioner Durga Shakti Nagpal, the action in this case related to government land has now shifted the full focus to securing the land and ensuring its use for government purposes. The case has been described as a major turn in a 30-year-old nazul land matter, where sustained monitoring and effective legal follow-up changed the course of the dispute.
Divisional Commissioner Durga Shakti Nagpal, Devipatan Mandal, said: “मा.
